2.5. Commercial Contracts Management: Implementation of the Best International Practices in Russia

Commercial Contract Management is an effective independent business-function, which includes elements of project management, legal, compliance, and cost control functions.

Contract Manager is assisting the Project Director in governance of the project; he/she has strong leadership skills and (very often) legal background. A Contract Manager is involved in the project starting form a bidding/tendering process and till the full performance of the project.

Having outstanding knowledge of the contract (for long-term complex projects this may include thousands of pages of contract-related documentation) accompanied by sound communication and leadership skills, Contract Manager helps to 'squeeze' maximum of profit  out of the project and prevent 'value leakage'.

Contract Manager is the first contact point on all contract-related issues.

Contract Manager is not just providing an advice on contractual matters; importantly – he/she is managing implementation of his/her advises and achieving results. Internal and external stakeholders’ management is one of the key responsibilities of the Contract Manager.

Contract management is specifically valuable for the business nowadays, during post-crisis period of economy, when the businesses are aimed at saving funds and gaining maximum profit.

Within this panel discussion we are talking about the role of commercial contract management in a view of business transformation and improvements. We are also discussing contribution of quality contract management into complex telecommunication and development projects as well as into investment and M&A transactions. In addition to that, we are looking at the interest of law schools’ graduates in the occupation of commercial contract management, and finding out, how legal studies and background may help to succeed in this occupation.

In the end of the discussion the representative of Russian company SIBUR will present the first Russian translation of the book 'Construction Contracts: Law and Management', which SIBUR uses for implementation of contract management in their business.

He also provides legal support on projects to restructure assets in the Russian Federation. He has over 15 years of experience in client representation in judicial disputes. He specialises in resolving disputes related to corporate, antitrust, labour and commercial law, as well as disputes with public authorities. Has over 18 years of teaching experience.

Mark is an Accredited Arbitrator with Associate of Institute of Arbitrators & Mediators Australia.

Mark says his major achievement is being a qualified English Teacher!

 

Professional experience:

Mark has previously worked and gained valuable experience in a variety of organisations ranging from New South Wales Fire Brigades, Reserve Bank of Australia, Major Chinese Sub-Contractors, Department of Education and Construction companies in UK and Stockholm and even a Lawyer for the Australian ‘FairWork’ Government authority checking for the fairness of contracts and for employees rights.

Mark also worked in Spain where he had a key role in the Barcelona Olympics contract close out.

Mark has just arrived in April to Copenhagen to the Head up the Scandinavia Operations of Build and Roll out for Nokia Telco.

With over 25 years’ experience in roles ranging from Quantity Surveying, Project Management, Cost & Contract Engineering, Claims Consultancy, Commercial & Regional Management.

Possessing first-hand experience of the challenges involved in delivering construction and engineering projects on time and to budget. Qualifications in Law; admitted as a Solicitor, arbitration practice and other forms of dispute resolution and can therefore bridge the technical – legal divide. Bridging the divide of bringing these skills together is important to understand project progress, cost management and applying the T&C’s when issues become troublesome.
