4.10. Long-Term Investments. Predictable Results Within the Russian Jurisdiction

For the purpose of implementation of Instruction by President of the Russian Federation V.V. Putin No. Pr-1132 dated June 14, 2017, based on the results of St.-Petersburg International Economic Forum 2017, the legislative bodies together with business community, government corporations and  companies have prepared a statutory package including the draft of the Federal Law “On Special Investment Contracts and Amendments to Certain Statutes of the Russian Federation” (SpIC).

The prepared package shall compliment the established practice of entering into SpIC under the Federal Law “On Industrial Policy”.

SpIC is a tool for attraction of long-term investments and private capital to new major investment projects.

Guarantee of unchanged business conditions (a “grandfather clause”), indemnification of a company implementing the project for its actual damages in case of default under the said obligations, possibility of investors indemnification for their expenses on the infrastructure from tax revenues of the project, technological development promotion and other specifics of SpIC 2.0.
