5.2. Alternative Dispute Resolution and Digital Justice

Alternative dispute resolution is a stable trend in recent decades. ADR practice influenced by digital technologies development is being expanded by designing and applying ODR instruments. These instruments provide new opportunities for access to justice. The necessity of enhanced access is the following: increasing complexity of economic relations, exponential growth for off- and online commerce and also for crossborder connections goes hand in hand with the one of disputes that need to be solved quickly and efficiently so that users would not mistrust new relations on the borderline between ‘real’ and ‘virtual’ worlds. This fact conditions the increasing demand for mediation and ODR in various spheres of economy, business and social relations.

The panel discussion is aimed at bringing together participants of the project Stories Mediators Tell initiated by Lela Love in cooperation with ABA, and founders of ODR conception and the ones of digital justice.

At the end of the round table there will be a presentation of the book written by Ethan Katsh and Orna Rabinovich-Einy "Digital Justice: Technology and the Internet of Disputes."

Practicing mediator/neutral in a wide range of cases from complicated cross-border commercial disputes to family conflicts, as well as intellectual property, workplace, financial, personal injury and medical malpractice disputes.

Specialist area, professional interests:

Alternative and Online Dispute Resolution; development, implementation of ADR in business environment; mediation in contemporary socioeconomic environment; implementation and development of restorative practice in educational environment and in society.

Achievements, rewards:
In 2005 she founded Center for Mediation and Law ( which during the following years became the main force in the efforts to build necessary conditions for successful implementation of mediation in the Russian Federation. Author of «mediative approach» and «school mediation» method.

In 2016 National Award for outstanding contribution and achievements in development of mediation in Russian Federation.

Prof. Shamlikashvili is the author of numerous research articles and several books on mediation, alternative dispute resolution, law, psychology and neurology.

Professional experience:
Professor Katsh is widely recognized as one of the founders of the field of online dispute resolution (ODR). Along with Janet Rifkin, he conducted the eBay Pilot Project in 1999 that led to eBay’s current system that handles over sixty million disputes each year.

His principal current research concern involves issues related to health care and, more particularly, to disputes over electronic health records

Winner of  2017 D’Alemberte-Raven Award  from the American Bar Association Section of Dispute Resolution

Winner of 2013 Annual Book Award from The International Institute for Conflict Prevention and Resolution (CPR)

Publications, scientific works:
With Professor Rifkin, he wrote Online Dispute Resolution: Resolving Conflicts in Cyberspace (2001), the first book about ODR. Since then, he has published numerous articles about ODR and co-edited Online Dispute Resolution: Theory and Practice, which received the International Institute for Conflict Resolution book award for 2012. Co-author (with Orna Rabinovich-Einy) of Digital Justice: Technology and the Internet of Disputes (2017, Oxford University Press)

Lela Love

Professor Love serves as mediator, arbitrator and dispute resolution consultant in community, employment, family, human rights, school-based and commercial cases.

Recipient of the 2010 Lifetime Achievement Award (for her exceptional contributions to advancing alternative dispute resolution personally throughout her career and inspiring others to do the same.)

Lela Love has written widely on the topic of dispute resolution, including co-authoring three law school textbooks.

One of the most important publication project is Stories Mediators Tell collection of stories told by outstanding mediators from all over the world.

Daniel Rainey

Louisiana State University, Southern University, Memphis State University, and the University of Pittsburgh, earning undergraduate and graduate degrees in communication. 

Professional experience:

He is a leading alternative dispute resolution (ADR) and online dispute resolution (ODR) educator and practitioner.  He is currently active as a teacher of graduate university courses in mediation, negotiation, conflict theory, international dispute resolution, and ODR.  As a consultant, he has worked with clients in the development of ODR resources, intercultural negotiation skills, Ombudsman programs, and organizational conflict engagement programs.

He has held faculty appointments at George Mason University and Southern Methodist University, and he is currently an Adjunct Professor at Southern Methodist University, Dominican University, and the University of the Pacific McGeorge Law School.

In October, 2017, he received the Mary Parker Follett award for innovation in dispute resolution.

Prof. Anyu (Andy) Lee has been a professor at University of International Business and Economy in Beijing, China since 2010。Prof. Lee serves as the chief scientist of the university’s eCommerce Research institute and manages the university’s Shenzhen Research Institute, which is a thinking tank founded jointly by the university and Shenzhen municipal government。Prior to the university, Prof. Lee was the director of eCommerce technology research center at China Academy of Sciences for 10 years。Before coming back to China, Prof. Lee worked in Silicon Valley for over 12 years as an engineer and research scientist in various companies including LSI Logic, Silicongraphic, HP Lab。 Prof. Lee founded Internet Image Inc. in 1997 and successfully merged with Intraware, a Nasdaq listed company。Prof. Lee was educated in Shanghai JiaoTong University (BS, MS), University of Arizona (MS), and Stanford University (Phd.) with HP corporate fellowship。
