Each of us takes dozens of decisions daily – where to go on holiday, what doctor to approach, how and where to have medical treatment, where to educate our children – and we don’t want other people to make such decisions for us. What happens if as a result of a severe injury or terminal illness we are no longer able to make our own decisions?

The concepts of a ‘living will’ and ‘advanced care plan’ – instructions in case of a grave illness or incapacity and end-of-life care planning, including the scope of potential medical interventions – have long been established worldwide.

At the event, we will be the first to speak of the right to express one’s will about oneself and one’s relatives.

Letter from Nyuta Federmesser, the founder of the VERA Hospice Charity Fund

«I would like to know how many of those present at the Forum have a will. My estimate would be – up to 15%, and the majority of the people answering in the affirmative would be guests from overseas. For Russian people, this practice is the exception rather than the rule. Even if we do commit to writing a will, most clauses would be about the time “when I’m no longer around” and be limited to our property. We will leave no written instructions that provide for a serious illness or loss of capacity; we will not address the questions “how to proceed when I’m alive but I cannot make decisions for myself or my children”.

I have been working with terminally ill people for over 20 years now, and my personal observation is that the percentage of people in possession of a will made in advance is scant; for those having a plan addressing a serious illness or loss of capacity [this number] approaches zero. For this reason, we often witness situations when relatives gather at the sick person’s bed and try to decide for them and [elicit] their wishes. And even if one of the relatives does know the wishes of the sick person, how do we prove that they were made by the patient themselves, not by their potential heir, in the absence of an appropriate legal document?

Unfortunately, current legislation does not provide us with an instrument that would enable us to legally attest a person’s wishes not pertaining to property issues, as well as guarantee that they will be carried out. The institute of legal representatives is absent in Russia. As a result, people wishing to receive specialized care at a hospice, where they are surrounded by their loved ones, as opposed to being alone at the intensive care unit, still end up at the ICU. A more sinister example is that after the death of a parent (or guardian) decisions concerning their disabled children are not made in their best interests. The child is referred to a specialized residential home and then transferred to a psychoneurological facility not hoping to ever come back home. For this very reason, I constantly hear parents of children with a disability say something that should never, under any circumstances, be said in the 21st century, “I’d like my child to die before me because I do not know what will happen to them if I should get sick and die”.

It is difficult for me to accept this state of things, in the knowledge that things can be different, that there is nothing impossible. We can get up tomorrow and visit a notary and write a will; but unfortunately, legislation amendments are required before any of our other decisions can be made legally valid. We do not have to invent anything new and can be guided by the experience of other countries where a regulated system of end-of-life planning has been in place for a long time (“living will” and “advanced care plan”). This includes such medical aspects as the right to refuse resuscitation, treatment with antibiotics, artificial nutrition, assisted ventilation, as well as wishes pertaining to the scope of treatment, legal aspects (choosing a person authorized to make decisions and carry out your wishes, a person authorized with guardianship of underage children or incapacitated relatives in the case of death), ethical aspects (list of persons allowed hospital visits, choosing a carer, type of final disposition, etc.).

While we are alive, while we are young and healthy, it is very difficult to accept the fact that we should plan ahead in case something should happen to us. It’s something we definitely do not want to think about, or put on paper. Objectively speaking, we are afraid. However, if it’s scary to think of, let us talk about it. We should fight our fears. And where do we do it, if not together with lawyers.»
